As permitted under North Carolina General Statute 47F, the Association has the right to impose fines if necessary to achieve compliance with association rules and regulations and only the Council of Stewards has the right to impose or waive fines. All fines are per item and shall begin five days after the decision that a violation occurs and continue until the problem is corrected. The Covenants Committee or the Council of Stewards has the right to waive all or a portion of the monetary fines. The following is not intended to be an exhaustive list of violations that could result in a fine, but merely as a list of the most common violations, which may serve as a reference for the Council when establishing fines for other violations.
Payment of a fine does not grant a variance from the violation. All violations must be corrected to comply with the rules and regulations. If there is a subsequent violation of the same rule, the amount of the fine may be doubled with each subsequent violation up to the maximum of $100.00 per day allowed by North Carolina General Statute § 47F-3-107.1.
